Terms of Use

The Terms and Conditions of Use (hereinafter “Agreement”) are provided by Kathryn Hutchinson, Attorney at Law, an online North Carolina law practice (hereinafter “Practice”) established in Holly Springs, North Carolina, and managed by attorney Kathryn Hutchinson, a North Carolina licensed solo practitioner (hereinafter “Attorney Hutchinson”). The Agreement will govern your use of this website, including all content provided herein, and access to all online services provided by The Practice or Attorney Hutchinson. 

Jurisdiction

The Attorney responsible for this site is licensed to practice law only in the State of North Carolina. 

The Practice and Attorney Hutchinson offer services related to North Carolina law only. This website shall not be deemed a solicitation for legal services related to any other state’s laws.  

The terms of this Agreement shall be governed by the laws of the State of North Carolina. 

The state and federal courts located in Wake County, North Carolina will have exclusive jurisdiction over any case or controversy arising from or related to this Agreement, this website, or any services provided by the Practice.  

Services Provided

You agree that you have not retained Attorney Hutchinson as legal counsel. By your use of this website, you agree that Attorney Hutchinson has not agreed to take on your case or provide you with legal advice. It remains your responsibility to proceed as a pro se litigant by filing any and all legal documents and complying with North Carolina state and local legal procedures.  

Kathryn Hutchinson, Attorney at Law, is a virtual law office that provides a variety of services. Based on the nature and level of service requested, the Practice may or may not be able to take on your case. This will be determined on a case-by-case basis based on availability, geographic location, legal practice area, level of service requested, and other various factors.  

No agreement for legal services nor an attorney-client relationship will be established between you and Attorney Hutchinson until a contract has been agreed upon and signed by both you and Attorney Hutchinson. 

Limitations of Services

This website and this legal Practice offer services related to North Carolina law only. This website shall not be deemed a solicitation for legal services related to any other state’s laws.  

Legal services provided by Kathryn Hutchinson, Attorney at Law, are based on the nature of services required, the location of legal filings required if necessary, and the extent of representation. Legal services provided will be determined by a set contract between you and Kathryn Hutchinson, Attorney at Law, which will not be deemed enforceable until payment of either flat fee or retainer has been received and a contract signed. If I am unable to provide the legal services you require for any reason, I will refer you to a North Carolina law firm in your area or the North Carolina Bar Association’s Lawyer Referral Service. 

Confidentiality

Any information received from you is held in strict confidence and will not be released to anyone outside this Practice unless you agree or as required under applicable law. This confidentiality protection does not create an attorney-client relationship, does not have any protections of the attorney client-relationship, and does not constitute attorney-client privilege under the Rules of Professional Conduct.  

All our records are securely retained in electronic files, along with secure backups, for the three years.

Fees

No fee will be charged or obligation incurred for using this website. Consultations will have a set consultation fee stated upon requesting a consultation. Fees, retainers, and hourly rates may be discussed during consultations if legal representation or services are requested. These fees, retainers, and hourly rates and their payment terms will be outlined in an agreement negotiated between you and Attorney Hutchinson if Attorney Hutchinson is retained for legal services.

Limitation of Liability

Kathryn Hutchinson, Attorney at Law, assumes no liability for any errors or omissions in the content of this website. The Practice will not be responsible under any legal theory for damages, including direct, indirect, incidental, consequential, or special arising as a result of your use of this website. The content of this website is not applicable in any state other than North Carolina.

Sending Funds via Electronic Transfer

You will not be asked to wire any funds for the use of this website or if entered into an agreement for representation. Any requests for wiring instructions should be presumed fraudulent.

Case Management Software

The Practice uses MyCase for case management software. If you become a client, you will be sent an invitation to sign up for the client portal through MyCase. You will not be sent this invitation until a contract for legal services is ready to be signed. While participation in MyCase is not required, it will immensely benefit both clients and Attorney Hutchinson in the course of representation. Attorney Hutchinson uses MyCase to send confidential communications to clients, assign tasks to clients, receive documents from clients, and create calendar events for both clients and Attorney Hutchinson through the MyCase software. This not only provides additional confidentiality protections that are not provided by email alone, but also streamlines many facets of the attorney-client relationship and management of the legal representation.

Severability

Each provision of this Agreement is severable. The invalidity or unenforceability of any provision paragraph, subparagraph, sentence, clause, phrase, or term of this Agreement shall not affect or impair the validity or enforceability of any other provision, paragraph, subparagraph, sentence, clause, phrase, or term of this Agreement.

Outcome Not Guaranteed

You agree that by your use of this website, you have not retained Attorney Hutchinson. By using this website, you indicate an understanding that the Practice nor Attorney Hutchinson have made an agreement with you or promises to you about the outcome or result of your legal matter.

Complete Understanding

This Agreement supersedes any prior or contemporaneous communications, representations, or agreements between Kathryn Hutchinson, Attorney at Law, and you, and constitutes the complete and final agreement between the parties relating to this Agreement or Kathryn Hutchinson, Attorney at Law’s website. If you have entered into a separate agreement for legal services with Kathryn Hutchinson, Attorney at Law, this Agreement is a supplement to that agreement for legal services, and in the event of any disparities, that separate agreement for legal services will control.
